This Privacy Policy was updated in 2024.

Cookie Policy In compliance with the provisions of the legislation on the protection of personal data, the provision of the Italian Data Protection Authority “Guidelines on cookies and other tracking tools” of June 10, 2021 (published in the Official Gazette No. 163 of July 9, 2021), as well as the provisions of other relevant regulations, T.M. PLANTS S.r.l., with registered office at Via Umberto Mariotti n°190 51100 Pistoia (PT), Data Controller, (hereinafter also referred to as “Controller”) informs you about the type of cookies and other tracking tools used by this website and the purposes pursued with the information acquired through them, also providing instructions for selecting/de-selecting individual cookies.

T.M. Plants S.r.l., as Data Controller, protects your personal data by ensuring confidentiality and compliance with current legislation and guaranteeing the necessary level of protection against any event that may put them at risk of violation.

This Cookie Policy (hereinafter also referred to as “Policy”) is intended to describe the management of cookies used by this site.

What are cookies and for what purposes can they be used?

A “cookie” is a text file created by a website on the user’s computer when the user accesses the same site, with the aim of storing and transporting information.

Cookies are sent by a web server to the user’s browser (Internet Explorer, Mozilla Firefox, Google Chrome, etc.) and stored on the user’s computer; they are then sent back to the website when subsequent visits are made.

Many of the operations that are normally performed on a website could not be completed without the use of cookies, which in such cases are therefore technically necessary. This type of cookie is called technical or functional. These cookies are used, for example, for electronic identification, session monitoring, and storage of information relating to users’ activities when accessing a website. When accessing this website, the user also receives cookies from third-party sites or web servers other than the website being visited, known as “third-party cookies.”

In other cases, the website uses cookies to facilitate and ease navigation by the user or to allow the user to use specifically requested services.

There are various types of cookies, depending on their characteristics and functions. These cookies can remain on your computer or mobile device for varying periods of time:

  • “Session cookies” are automatically deleted when you close your browser;
  • “Persistent cookies” remain or may remain on your device until their pre-set “expiry.”

Cookies may, therefore, remain in the system for considerable periods of time and may also contain a unique identification code. This circumstance allows the sites that use them to track the navigation carried out within the site, for statistical or advertising purposes, or to create a personalized profile based on the pages you have visited and to show and/or send you targeted advertising (so-called Behavioral Advertising).

According to current personal data protection legislation, your consent is not always required for the use of cookies.

For example, “technical cookies,” i.e., cookies that are essential for the operation of this website or necessary to perform the activities you have requested, can be used without your consent.

“Profiling cookies,” on the other hand, i.e., cookies used to create user profiles and send messages in line with the preferences expressed by the users themselves while browsing the Internet, require explicit consent.

This website uses the following types of cookies:

  • Technical cookies: these include both session cookies and navigation cookies, which are strictly necessary for the operation of the website and/or allow you to use the content and services of the website;
  • Functionality cookies, which are used to activate certain functions of the website and to configure the same according to your choices (for example, the language you have selected) to improve your browsing experience;

This website also uses third-party cookies: these cookies, sent by websites/servers other than this website, are used for the specific purposes of the third parties who own the websites/servers (including profiling purposes). An example of these are the cookies released by social networks through the so-called social buttons, which allow you to interact with social networks such as Facebook or Twitter (see the “social buttons” section of this document).

These third parties are considered Autonomous Data Controllers with regard to their cookies; T.M. Plants S.r.l. cannot control or verify the use of such cookies by third parties, nor ascertain the specific characteristics or purposes of these cookies. For any information on how your data is processed by these third parties, you can refer to the relevant information and privacy policies or other material published by the same third parties.

Social buttons

This website contains buttons, called “social widgets/buttons,” that depict the icons of some social networks.

These widgets allow users of the site, who are browsing this website, to access the relevant social networks with a “click.” In this case, the social network and web services acquire user data, while T.M. Plants does not share any browsing information or personal data of the user, acquired through its website, with the social networks and web services accessible via these tools.

These buttons are deactivated by default, meaning they do not send data to the respective social networks without your consent.

To activate the buttons, simply select them. After activation, a direct connection is established with the server of the respective social network. The content associated with the button is then transmitted directly from the social networks to your browser and linked by the latter to the web page.

To learn about the purpose and scope of data collection and processing/use of personal data by social networks and third-party websites, on which T.M. Plants has no control, you can access the privacy policies available on the social networks’ portals.

Below are links to the privacy policies of the social networks to which the buttons on this site refer:

Legal Basis of Processing

The legal basis underlying the processing of personal data mentioned in this document is:

  • With regard to technical cookies:
    Article 6(1)(b) GDPR: processing is necessary for the performance of a contract to which you are a party or to take steps at your request prior to entering into a contract;

Your Rights

Pursuant to Regulation (EU) 2016/679, you have the right to:

  • Obtain confirmation from the Controller regarding whether your personal data is being processed;
  • Access your personal data and learn about its origin (when your personal data is not obtained directly from you), the purposes of the processing, the data of the subjects to whom it is communicated (recipients), the retention period of the data, or if not available, the criteria useful for determining it;
  • Obtain the rectification of your personal data;
  • Obtain the deletion of your personal data from the Controller’s databases if it is no longer necessary for the purposes for which it was collected or if the processing is unlawful, and in other cases provided for in Article 17 of the GDPR;
  • Restrict the processing of your personal data, for example, where you dispute its accuracy, for the period necessary for the Controller to verify its accuracy, and in all other cases provided for in Article 18 of the GDPR;
  • Obtain your personal data in an electronic format, also in order to be able to transmit it to another Data Controller (portability).

You can exercise your rights by contacting the Controller by written communication to the address info@tmplants19.com.

The Controller must act on your request without delay and, in any event, no later than one month after receiving your request. The deadline may be extended by two months, and in that case, the Controller will always inform you within thirty days of the reasons necessitating the extension.

Complaint

You have the right to file a complaint with the Data Protection Authority.

If you reside in an EU member state other than where the Controller is located, or if the violation of the personal data protection regulations occurs in another EU country, you must file your complaint with the Authority responsible for monitoring compliance with the personal data protection regulations in that country.

Filing a complaint does not preclude the possibility of pursuing any other legal action.
